While stopped in traffic, our client, an Ocean County man, was injured as a result of being rear ended by a dump truck. The plaintiff was receiving treatment for a prior neck problem at the time of the collision, but required surgery after the additional problems caused by the accident.

Following the surgery, plaintiff was unable to return to his former occupation; however, his lost wages and medical bills were paid by insurances he had. For this reason, they were not an element of the damages in the lawsuit.

A claim was also brought on behalf of plaintiff’s wife for loss of consortium. The defense contested that the plaintiff’s damages were due to the accident, because of all the prior and ongoing treatment he was receiving at the time of the accident.

The defendants contested the matter all the way into the third day of trial before agreeing to settle the matter with the plaintiffs. The case was ultimately settled for $1.2 million.
