Motorcycle Laws in New Jersey

Motorcycle laws in New Jersey are designed to ensure the safety of riders and other motorists on the road. To legally operate a motorcycle in the state, a person must either obtain a motorcycle license or add a motorcycle endorsement to their existing driver’s license. This requires passing both a written knowledge test and a road skills test, or completing an approved Motorcycle Safety Education Program. Riders under 18 are required to complete such a program before obtaining a license or endorsement. Additionally, all motorcyclists and passengers are mandated by law to wear a securely fitted, DOT-approved helmet. Protective eyewear is also required unless the motorcycle is equipped with a windscreen.

State law also governs the operation of motorcycles in terms of safety and traffic regulations. For instance, lane splitting—riding between lanes of traffic—is illegal in the state. Motorcycles must also be equipped with specific safety features, such as a rearview mirror, working horn, and adequate lighting. Moreover, motorcycles are entitled to the full use of a lane, and other vehicles are not allowed to deprive a motorcycle of this right.

In terms of accidents involving motorcyclists, New Jersey follows a "no-fault" insurance system for most motor vehicle accidents. However, motorcycles are exempt from this system, meaning that injured riders must seek compensation through a fault-based claim against the at-fault party. This makes it essential for motorcyclists to carry adequate liability insurance. In the event of an accident, the injured motorcyclist may file a personal injury lawsuit to recover damages such as medical expenses, lost wages, and pain and suffering. Proving negligence is a key element in these cases, requiring evidence that the other party breached their duty of care, resulting in the accident.

The state also follows the doctrine of comparative negligence. This means that if a motorcyclist is partially at fault for an accident, their compensation will be reduced by the percentage of their fault. However, if the motorcyclist is found to be more than 50% responsible, they may be barred from recovering any damages. Because of these complexities, it’s often advisable for injured riders to consult with an attorney who specializes in motorcycle accidents to navigate the legal process and protect their rights.

Determining the Cause of Your Motorcycle Accident

Motorcycle riders are much more exposed on roadways than a car or truck driver. That means when an accident does occur, the damages can be devastating.

It is important to understand what caused your accident so you can hold the appropriate party liable. Some of the leading issues of driver negligence include:

  • Cars making left-hand turns
  • Road hazards, including fallen cargo
  • Vehicles making unsafe lane changes
  • Vehicle lane drifting
  • Speeding or reckless driving
  • Drunk or distracted drivers
  • Motorcycle or equipment defects

Whether a product manufacturer is to blame or a reckless driver is at fault, Levinson Axelrod, P.A. has the resources to fully investigate your accident and gather needed evidence. We have experience crafting compelling claims and can walk you through the complex legal process step by step.
