New Jersey Car Accident Laws

New Jersey follows a no-fault insurance system, which requires drivers to carry Personal Injury Protection (PIP) insurance. Under this system, injured parties must initially turn to their own insurance policies for medical expenses and other out-of-pocket costs, regardless of who was at fault for the accident. This system is designed to expedite the claims process and reduce litigation for minor accidents.
New Jersey also provides drivers with the choice of a limited right to sue or an unlimited right to sue when purchasing auto insurance. If a driver opts for the limited right to sue, they can only pursue legal action for non-economic damages, like pain and suffering, if their injuries meet certain thresholds, such as significant disfigurement, dismemberment, or permanent injury. However, if a driver selects the unlimited right to sue, they retain the ability to sue for non-economic damages without these restrictions.
The state adheres to a comparative negligence rule, which means that an injured party can recover damages only if they are less than 50% at fault for the accident. However, the compensation they receive will be reduced in proportion to their share of fault. For instance, if a plaintiff is found to be 20% at fault and the total damages amount to $100,000, they would receive $80,000.
