Last week, Levinson Axelrod, P.A. Partner Joe Marabondo prevailed at trial when a Middlesex County jury returned a half-million-dollar verdict in a case where our client suffered neck and back injuries in a motor vehicle accident.
As court records show, Joe represented a client who was involved in a car accident in June 2021 in Middlesex County. As a result of the crash, our client suffered injuries to his neck and back. Defendants contested liability, proximate cause, and damages, noting the client did not present to the hospital with back pain. Subsequent testing and an MRI resulted in the finding of a spasm in his neck and what Joe argued was a disc herniation in his lower back but Defendant argued were bulges with no clinical significance. The client underwent a lumbar epidural to treat his lower back injury and a cervical medial branch block for his neck, had three total pain management visits, and received a total of six months of chiropractic treatment, including 5 months of treatment after the crash in 2021 and one month of chiropractic treatment in December 2023.
Defendants also attempted to use social media photographs served just hours before opening but Joe was able to use them to the client’s advantage. Fortunately, Joe was able to present his client’s case to the jury in a compelling manner and was additionally successful in conveying the full scope of his injuries and losses. Following a week trial in Middlesex County Superior Court, the jury returned a verdict of $500,000.
