Levinson Axelrod, P.A. Partner Brett Greiner secured a $1 million settlement at mediation for a truck driver who was injured after slipping and falling on ice.
As court records show, the case arose from an incident that occurred when our client reported to work at 4:00am to retrieve his work truck and slipped and fell on a patch of ice located outside of the dispatcher’s office.
As a result of the fall, our client suffered a neck injury involving herniated discs. While receiving therapy for his neck, he injured his rotator cuff in one of his shoulders and was required to undergo arthroscopic surgery to repair the tear.
In addition to his rotator cuff surgery, our client received pain management treatments for his neck injury that included epidural injections and a radio frequency ablation, a procedure in which radio waves are sent through a precisely placed needle to heat nerve tissue and which is commonly used for neck injuries that haven’t been successfully treated with other methods. Given that our client continued to experience pain and symptoms in his neck, his treating doctor also proposed surgery for the neck injury, but our client decided to hold off on the procedure to avoid missing additional time from work.
In litigating the case, Brett pursued compensation from the defendants based on premises liability. In New Jersey, parties that own and control a premises are obligated to ensure their property is free from unreasonable hazards, including hazards like ice that pose foreseeable risks of harm, and can be held liable when their negligence in maintaining a premises causes preventable injuries. While a trial date was set for the case, Brett was ultimately able to secure a $1 million settlement from the defense at mediation just a few weeks before the trial was scheduled to begin.
