Joseph Marabondo, a Levinson Axelrod, P.A. Partner from our office in Edison, recently secured a six-figure policy limits settlement on behalf of a client who was injured in a single-vehicle crash.
As noted in court records, Joe represented a client who was traveling as a passenger in a motor vehicle that lost control and collided into a tree. As a result of the collision, our client sustained a lower leg injury that necessitated surgery.
Because our client did not have his own insurance, Mr. Marabondo pursued compensation from the vehicle owner’s auto insurance carrier. However, he encountered challenges when the defense contended that our client had been working at the time of the crash, a condition that would have triggered an exclusion under the subject policy.
Thankfully, Mr. Marabondo was able to successfully clarify the matter toward the end of the discovery phase after supplying evidence that showed our client was not working at the time of the collision. As a result, he was able to secure a $300,000 settlement for the client, which was the full limits of the vehicle owner’s insurance policy.
This case serves to highlight the importance of working with counsel that is diligent and aggressive in obtaining evidence to defeat challenges raised by insurance carriers, particularly when disputes threaten a victim’s ability to secure any form of compensation. Had the policy exclusion in this case applied, for example, there would have been no recovery.
