As detailed in court filings, Joe represented a client who tripped and fell while shopping at a large, big box retail store. As a result of the fall, our client suffered a knee injury and was required to undergo surgery to repair the damage.
Because premises liability actions allow plaintiffs to hold property owners accountable for injuries caused by hazardous conditions, Joe sought compensation from the defendant retail store.
However, he encountered challenges when the defense claimed that it had no notice of the dangerous condition. This posed a significant threat to our client’s claim, as it is the plaintiff’s burden in premises cases to prove that property owners knew (i.e. had actual notice of a hazardous condition) or should have known (i.e. the dangerous condition existed for a sufficient period of time that the property owner, in the course of exercising reasonable care, should have known about it) about hazardous conditions on their property that posed reasonable risks of injury.
Given the defendants’ position, Joe invested considerable time and effort into proving his client’s claim that the store created the dangerous condition which injured his client and that his client therefore did not need to prove notice. Ultimately, Joe’s countless cumulative hours of hard work on this fact-specific case proved successful when he was able to secure a $350,0000 settlement. This recovery will help cover our client’s medical expenses, lost income, and other damages.
