Levinson Axelrod, P.A. Partner Rich Marcolus of our Belford office recently secured a six-figure workers’ compensation settlement with re-opener rights for future treatment and additional benefits for a client who was injured on the job.
As detailed in court records, Rich represented a worker who injured her neck and right shoulder while pulling items down from a shelf. The neck and shoulder injuries required surgical treatment.
When litigating the case, Rich encountered pushback from the workers’ compensation insurer, which opposed applications for specific doctors to address his client’s condition. As a result, the case required multiple motions and court hearings so the Court could order the insurance company to have our client treated by doctors who performed the appropriate testing to identify the conditions which required surgery.
Thanks to Rich’s persistence, he prevailed in obtaining the necessary treatment for his client, which ultimately allowed them to return to work. He secured a total settlement of $250,575 with re-opener rights that will also allow his client to seek benefits for any additional future treatment and compensation they may require.
