Levinson Axelrod, P.A. Partner Mark Kuminski recently secured a $950,000 settlement for a client who was injured in a motor vehicle accident where her vehicle was struck from behind.
Mark’s client was the driver of a vehicle which was stopped at an intersection for a red traffic light in the right turn lane. A commercial dump truck was stopped behind her. When the green arrow light activated for the left turn lane, the dump truck proceeded to pull forward, striking her stopped vehicle from behind.
As a result of the collision, Mark’s client suffered a herniated disc in her lower back, which subsequently caused one of her legs to give out while she was descending a set of stairs at her home. This caused her to fall on the stairs, aggravating her low back injuries and requiring her to undergo pain management treatment and ultimately surgery.
In litigating the case, Defendants attempted to argue that our client’s lower back injuries were the result of her prior low back conditions, for which she had previously undergone extensive medical treatment and testing, including having treated for same the day prior to her motor vehicle accident. The Defendants also claimed that her subsequent fall at home was not causally related to her automobile accident, and that they were therefore not responsible for the injuries she suffered in that fall.
Despite these challenges, Mark was able to effectively prove a connection between the collision and his client’s injuries, securing a settlement totaling $950,000.
