Levinson Axelrod, P.A. Partner Adam Rothenberg of our Edison office recently recovered a $2 million medical malpractice settlement for the family of a victim who passed away due to complications arising from surgery.
Adam represented the family of a patient who suffered complications after undergoing abdominal surgery. As a result, she was comatose for most of the time following surgery and later succumbed to the complications.
While representing the patient’s surviving adult children, Adam was able to effectively prove liability, in part, by researching the publications of the defendant. However, he encountered difficulties when seeking damages, as the law limits financial recoveries in medical malpractice cases only to damages for conscious pain and suffering (in addition to tangible economic losses) and because the plaintiff had very limited periods of conscious pain and suffering and was not an income producer.
Despite these challenges, Adam was able to effectively negotiate a six-figure settlement with the defendant, which will provide his clients with $2 million in compensation.
