Kelley Lavery, a Levinson Axelrod, P.A. Associate from our Edison office, recently recovered a six-figure settlement for a client who was injured in a rear-end accident with a commercial truck.
According to court filings, Kelley’s client was a self-employed delivery man who was traveling on Route 1 in North Brunswick at the time of the crash. While stopped in traffic, his vehicle was rear-ended by a truck, causing injuries to his shoulder and arm. He later underwent a left shoulder arthroscopic surgery with repair to his left bicep.
While representing his client in negotiations with the at-fault party’s insurance carrier, Kelley encountered resistance from the defense. Namely, the defense attempted to blame our client for his injuries, arguing that he was responsible for the collision because he merged in front of the defendant and was not wearing a seatbelt.
Fortunately, Kelley was able to effectively counter the defense’s arguments and recover a total of $262,500 in compensation through mediation. This amounted to $37,500 more than the amount of compensation awarded through a prior court-ordered arbitration.
