Levinson Axelrod, P.A. Partner Brett Greiner recently secured a $1+ million settlement for a client who suffered significant injuries caused by an uninsured driver.
As court records show, Brett’s client was traveling in his vehicle when it was cut off by another motorist. The incident caused our client to collide into a barrier and resulted in fractures of his shoulder and lower arm. The motorist who recklessly merged into our client’s lane fled the scene of the accident.
As a result of his injuries, our client underwent surgery to implant several screws to reduce his fractures. Despite the successful surgery, however, our client was left with a lasting disability that impacted the use of his non-dominant arm.
The primary challenge in litigating this case was the fact that the at-fault driver fled the scene and could not be located. Fortunately, Brett’s client carried Uninsured Motorist coverage as part of his auto insurance policy. Brett subsequently brought a claim for uninsured motorist benefits against the client’s own insurance carrier.
While the litigation was proceeding, Brett was able to secure a settlement totaling $1,225,000 from the insurance companies that issued the underlying and excess uninsured motorist coverage.
This case is yet another example of the importance of purchasing Uninsured/Underinsured Motorist (UM/UIM) coverage as part of your auto insurance policy. While this is optional coverage that may minimally increase your premiums, it can prove invaluable should you be injured by an uninsured motorist, underinsured motorist, or hit-and-run driver.
