In May, Levinson Axelrod, P.A. Partner Todd Wachtel recovered a $290,000 settlement in a dependency claim over cancer allegedly caused by toxic exposure in the workplace.
According to court records, Todd represented the widow of a former client who passed away from cancer. In her dependency claim, it was alleged that her late husband’s cancer arose from his employment, which required him to use various chemicals and pesticides.
Todd encountered several challenges litigating this case, including the employer’s denial of the claim and its various efforts to prevent our office from obtaining any information relevant to the case. After filing well over 10 motions for discovery and a series of failed negotiations, the matter was listed for trial and was eventually settled only moments before the first witness was to take the stand.
Thanks to Todd’s persistence in pursuing information from the employer and his willingness to litigate in court, his client was positioned to obtain a fair settlement totaling $290,000 just prior to trial.
