Levinson Axelrod, P.A. Partner Adam Rothenberg recently secured a $160,000 settlement for a client who fell and fractured their wrist.
As documented in court records, Adam’s client had been going to the dentist when she tripped and fell on a raised threshold leading into the building. His client, who was elderly, suffered a severe wrist fracture that required surgical repair with a plate and screws.
In pursuing compensation for his client, Adam faced strong opposition from the defendant, who denied liability on claims that the version of the accident told to the dentist differed from what was told to other health care providers, thereby suggesting other causes for the fall.
In working to overcome the defendant’s arguments, Adam fought to show that what his client said was in fact consistent and would likely result in a verdict on their behalf. To bolster his position, he hired an engineering expert and an orthopedic expert who provided testimony in support of the claims.
Despite the potential difficulty in proving liability, Adam’s efforts proved successful and he was ultimately able to secure a fair settlement for his client’s medical expenses, pain and suffering, and other damages.
