In December, Levinson Axelrod, P.A. Partner Chris DeAngelo was successful in obtaining a six-figure recovery for a client who was injured in a motor vehicle collision.
As court records show, Mr. DeAngelo’s client had been struck from behind by another motorist while stopped in traffic. The client sustained neck and lower back injuries that necessitated a multitude of pain management procedures.
Because the at-fault driver carried only $50,000 in bodily injury coverage, which was quickly tendered, the case centered largely on an underinsured motorist claim filed against our client’s own auto insurance carrier. To complicate matters, our client’s insurance company argued that all injuries suffered by our client were preexisting.
Despite these arguments, Mr. DeAngelo was able to overcome the insurance company’s reluctance to compensate and secure an additional $172,500 for our client’s injuries. With the underlying $50,000 policy-limit settlement against the at-fault driver, this brought the total recovery to $222,500.
Mr. DeAngelo’s case is a testament not only to the types of results secured by proven attorneys, but also the importance of carrying UM / UIM coverage as part of your auto insurance plan. Such coverage can make the difference for victims injured by underinsured or uninsured motorists by allowing them to recover from their own insurance carrier.
