As detailed in court filings, Kelley’s client had been shopping at a major grocery store when they tripped over a digital kiosk located in a high traffic area and fell. The incident resulted in the Plaintiff suffering a left hip fracture that required immediate surgery, as well as time for recovery and rehabilitation.
Because property owners can be held liable for guest and patron injuries caused by unaddressed hazards, the Plaintiff had a viable premises liability claim against the grocery store. Following negotiations with the Defendant, Kelley was able to secure a $300,000 settlement, which will help compensate his client for their medical bills, pain and suffering, and other resulting damages.
