Levinson Axelrod, P.A. Partner Brett R. Greiner recently secured a six-figure settlement on behalf of a client who was injured in a slip and fall accident.
According to court documents, Brett’s client slipped and fell on wet tile when stepping out of a shower at a gym where he was a member. Although there was a mat outside of the shower stall when he first entered, someone had removed the mat to mop the floors while he was showing.
As a result, Brett’s client stepped onto the tile, slipped, and fell. He suffered a fracture to his humerus, a bone in the arm which runs from the shoulder to the elbow, and was required to undergo a surgical procedure to repair the fracture.
The defendant in the case alleged that there was no mat outside of this particular shower stall, and that the plaintiff should have worn slip-resistant footwear. Thanks to Brett’s efforts in preparing evidence and arguments to challenge the defense, the matter settled for $375,000 during litigation.
Because he was able to work from home following the surgery Brett’s client did not lose any wages. The money recovered was to compensate Brett’s client for his pain, suffering and disability related to the injury.
