Levinson Axelrod, P.A. Partner James J. Dunn and Attorney Kathleen M. DiGiovanni recently obtained a $500,000 policy-limit settlement for a client who was seriously injured in a motor vehicle accident. The settlement was reached on the second day of trial in Ocean County, New Jersey.
As noted in the lawsuit filing, our firm’s client had been stopped in traffic on Burnt Tavern Road in Brick, NJ when she was struck from behind by the defendant. The force of the rear-end collision pushed her vehicle into another automobile which had been stopped in front of her.
As a result of the initial collision and second impact, our client sustained serious and permanent injuries to her lumbar spine. Treating medical professionals performed a spinal fusion surgery to join damaged vertebrae.
Given the nature of our client’s injuries, Jim and Kathleen decided to take the case to trial. On the second day of litigation, when the defendant’s insurer realized the scope of evidence and medical records supporting our clients’ condition, pain and suffering, and prognosis, a settlement was reached and trial was ended.
Thanks to their efforts, our client obtained a $500,000 settlement – which was the maximum amount of compensation available, as the defendant’s insurance policy limit was $500,000. The recovery will provides our client with the recompense she deserves for her medical expenses, pain and suffering, disability, and loss of enjoyment of life.
