“As recovery companies become more aggressive in chasing medical expenses and Medicare and Medicaid require set-asides, future medical expenses will become a bigger part of personal injury litigation and our courts will be called on to resolve these claims,” Rothenberg wrote. “The framework for recovery of these expenses is still within the traditional principles of negligence, that the liable party is responsible for all reasonable damages flowing from its negligence.”
